The Public Safety and Homeland Security Bureau issued the determination without public rulemaking, published guidance, or a clear definition of which products or countries are covered, leaving manufacturers, developers, and utilities unable to assess compliance or plan procurement.

The move arrives as solar and storage deployment accelerates under the Inflation Reduction Act, with inverters serving as the critical interface between DC generation and the AC grid. Domestic production capacity remains limited, concentrated in a handful of facilities that cannot meet near-term demand. Industry groups warn that an opaque ban could stall projects, raise costs, and undermine grid reliability targets, particularly in regions where imported string and central inverters dominate utility-scale and commercial installations.

Critics argue the FCC lacks both the statutory authority and the technical expertise to regulate power equipment on security grounds, a role traditionally held by the Department of Energy and the Department of Homeland Security through established supply-chain review processes. The absence of a transparent methodology — such as a published list of prohibited entities, technical criteria, or an appeals mechanism — fuels suspicion that the action is driven more by trade policy than by documented vulnerabilities. Several manufacturers have reported that their products, assembled in allied nations using globally sourced components, fall into a regulatory gray zone with no path to certification.

Until the FCC provides a detailed framework or Congress intervenes to clarify jurisdiction, the industry faces a de facto procurement freeze on the majority of available inverter models. Developers are already delaying financial close on projects with 2025 and 2026 commercial operation dates, and EPCs are rewriting specifications to accommodate uncertain compliance timelines.
